If your business owns, leases, or rents vehicles in Virginia, your personal auto policy almost certainly will not cover them. Commercial auto insurance is a separate policy built for vehicles used in the course of business — and in Virginia, the rules changed recently in a way many business owners have missed.

Virginia’s minimum liability limits increased in 2025
For policies effective on or after January 1, 2025, Virginia requires every registered motor vehicle — personal or commercial — to carry at least:
- $50,000 for bodily injury or death of one person in an accident
- $100,000 for bodily injury or death of two or more people in an accident
- $25,000 for property damage
These limits are set in the Code of Virginia § 46.2-472 and published by the Virginia DMV. The previous minimums — $30,000/$60,000/$20,000 — applied to policies effective January 1, 2022 through December 31, 2024.
One other change matters: Virginia previously allowed vehicle owners to pay an uninsured motor vehicle fee instead of buying insurance. That option no longer exists. If your business registers a vehicle in Virginia, it must be insured.
State minimums are a legal floor, not a business decision
Here is the part we spend the most time on with business owners in Alexandria and Northern Virginia: $50,000 in bodily injury coverage sounds substantial until one of your vehicles is involved in a serious accident on I-95 or the Beltway. A single injury claim involving surgery and lost wages can exceed that figure quickly, and when the policy limit is exhausted, the business is responsible for the remainder.
Most commercial auto policies we write carry a combined single limit well above the state minimum, often paired with a commercial umbrella policy that sits on top. The right number depends on what your vehicles do, what they carry, and what your business has to lose.

When you need commercial auto rather than personal auto
The dividing line is not what the vehicle looks like — it is how the vehicle is used and who owns it. You generally need a commercial auto policy if:
- The vehicle is titled or registered to a business entity, including an LLC
- Employees drive it, whether or not it is company-owned
- It hauls tools, equipment, materials, or goods for the business
- It carries a permanently attached ladder rack, tool box, or specialized equipment
- It is used for deliveries, service calls, or transporting clients
- It exceeds a certain weight rating, or requires a CDL to operate
A common and expensive misunderstanding: a personal auto policy can deny a claim if the vehicle was being used for business at the time of the accident. Contractors, landscapers, caterers, and delivery operations are the businesses most often caught by this.
Coverages worth understanding
Hired and non-owned auto liability
This covers vehicles your business does not own but does use — rented vehicles, and employees’ personal cars driven on company errands. If an employee causes an accident while running a business errand in their own car, the injured party can pursue your business. Many businesses with no vehicles at all still need this coverage.
Physical damage: comprehensive and collision
Liability pays for damage your vehicle causes to others. It does nothing for your own vehicle. Comprehensive and collision cover your vehicle — and for a business that cannot operate without its trucks, replacement speed matters as much as the payout.
Uninsured and underinsured motorist
Virginia has a meaningful population of drivers carrying only the state minimum. If one of them injures your driver, this coverage is what stands between your employee and an uncompensated loss.
Medical payments
Covers medical expenses for your driver and passengers regardless of fault, typically without the delays that come with sorting out liability.
What actually drives your premium
Commercial auto pricing is more individualized than personal auto. The factors carriers weigh most heavily include:
- Driving records of everyone who operates your vehicles — usually the single largest factor
- Vehicle type, weight, and value
- Radius of operation — local delivery rates very differently from long-haul
- What you haul, and whether it is hazardous
- Your claims history
- Liability limits and deductibles selected
Because rates vary this widely between carriers, comparing quotes on commercial auto tends to produce larger differences than it does on personal lines. - Run motor vehicle records before you hire a driver, and re-run them annually. One driver with violations can move your entire fleet’s rate.

- Consider telematics. Several carriers now offer meaningful credits for monitored driving behavior.
- Bundle with your general liability and property coverage. Package policies frequently price better than separate ones.
- Revisit deductibles if your business can absorb more of a small loss.
